Terms of sale

1) General
The products on the e-commerce website www.labfirenze.com are offered by LAB Firenze S.r.l., a company registered in the Florence Company Register with tax code 06914160483 e VAT number 06914160483. The head office is in Florence (FI) via Garibaldi 15, 50123, Italy. The email address is info@labfirenze.it; the phone number is +39 3713362514. Purchases made via the internet on the e-commerce site are governed by Italian law and by these contractual conditions indicated on the site at the time the order is made (the “Conditions General “). Any disputes that may arise on the conclusion, interpretation, and execution of a sale stipulated through the LABFIRENZE e-commerce will be devolved to the exclusive jurisdiction of the Italian judicial authority.

2) Users and Orders
Only end consumers can use the Lab Firenze e-commerce site, that is natural persons of age who act for purposes not related to commercial activity, entrepreneurial, artisan, and / or professional, if any, and that fall within the definition of “consumers” contained in Legislative Decree 206/2005 and subsequent amendments (the “Code of Consumption”). 206/2005 e s.m.i. (il “Codice del Consumo”). LAB Firenze will consider valid and effective and will only consider the purchase orders that have the following characteristics: – orders may come from all over the world with the exception of Syria, Iraq, Iran, Afghanistan, Yemen, Papua New Guinea, and all the small Pacific states, Myanmar, Nepal, Bhutan, Bangladesh, Cambodia, Laos, North Korea, Mongolia, Guyana Suriname Venezuela, every African country (with the exception of South Africa, Egypt, Morocco, Tunisia) and in general every nation in which it is difficult to manage shipments by express courier. – orders can only be processed if they concern a maximum of n. 10 articles, and, in each case, for a maximum total value of € 7,000.00 (or the equivalent in US dollars) – orders will be processed by Lab Firenze only if shipping is requested internally the territory of the price list from which the order is made. All orders that do not have the above characteristics will not be accepted, and if accepted may be considered invalid and ineffective by Lab Firenze which reserves, in fact, the right not to execute orders that do not have the above characteristics. It is also understood that Lab Firenze may not process the order and / or consider it ineffective when it is not possible to verify the correctness of the information relating to the address of shipping and billing information, or the same was made for resale purposes, case in which Lab Firenze reserves the right to terminate the contract with immediate effect with a simple written communication sent by email.

3) Prices
The purchase prices of Lab Firenze products are in euros for the Europe Russia area included and in US dollars for the rest of the world: they are “ex work” to which is added a flat rate for shipping costs. However, the prices are DDP (Delivered Duty Paid) for the USA, Canada, and South Korea, while any local taxes remain the responsibility of the customer. Lab Firenze will be able to apply special promotions to one or more products on the site that change the price. The essential characteristics of the products and the prices are indicated in the product sheet present on the site to which the user must access before executing the order. The images of the products may not fully match the real ones.

4) Shipping
The costs of transporting the product will be borne by the user of the e-commerce service which will be explicitly indicated during the purchase of the same. Lab Firenze is committed, as the user in charge, to enter into a shipping contract with a primary holding company account of the conditions practiced by the carrier itself. Returns: The return costs for items not conforming to the order are borne by Lab Firenze which will inform the customer of the methods of returning the goods which must in any case normally be delivered at a collection center indicated by LAB Firenze

The Client: – may indicate that the purchase is sent to a different address than that of the holder of the order and / or billing (provided within the same geographic area of reference(for example Europe or Russia); – must indicate a shipping address to which someone is always present to collect the package.In the event that someone is not present at the address indicated for the collection, a different address must be indicated with respect to the residence where the required condition is fulfilled; – Lab Firenze will normally process the order within 48/72 hours after receiving the confirmationof payment. The estimated delivery times depend on the carrier chosen.However, normally not more than 5/7 days. Furthermore, once the shipment has been made, Lab Firenze will automatically send an email containing all the information the user needs to trace the order, including the direct link to the portal of the carrier chosen for immediate verification of the status of delivery. Lab Firenze is in any case not responsible for the missed and / or delayed delivery of the package if the withdrawal methods described above are not respected, or however, Incorrect indications by the customer were given; – if the ordered items are not delivered within a period of 10 working days after confirming the order, the user can directly contact LAB Firenze customer service. The status of the order and/or the status of the shipment will be verified through the Carrier site. The customer is entitled to a discount equal to the shipping cost if the order is greater than or equal to 10 times the shipping cost itself.

5) Order filling
To conclude the purchase contract, the user must complete the order procedure present on the site in all its parts and confirm the payment of the order itself on the site of the selected payment institution. 8) Compilation of orders and responsibilities
To complete the purchase contract, the order procedure must be completed and payment on the site of the selected institution. (1) cancel the order, the delivery of which will therefore not be carried out, sending simultaneously a communication in this regard by e-mail, to the e-mail address indicated by the user during the compilation and transmission of the order and (2) refunding the user payments made by the same in relation to the canceled order, inclusive of costs of delivery, without undue delay and, in any case, no later than 14 days from cancellation of the order, using the same payment method used by the user for the transaction initial;

(b) if the user has received the product, Lab Firenze will promptly inform by e-mail the user of the error that occurred in the process of completing their order, offering to alternatively, to (1) pay to Lab Firenze no later than the following 5 (five) days, through one of the available payment methods, the amount corresponding to the difference between the correct price of the product and the incorrect price resulting from the purchase order, or (2) cancel your order, following the instructions contained in the same communication and returning the product to Lab Firenze, at the expense of the latter, no later than the following 14 (fourteen) days, sending it to Lab Firenze, without damage, complete with all its elements and accessories (including unaltered labels and tags attached to the product), accompanied by each attachment present in the original packaging (packaging included and accompanied by the return form, properly completed, which will be attached to the e-mail sent to Lab Firenze srl. in which the user has chosen the option referred to in point (b.) above.

(2) Lab Firenze will reimburse the user for payments made by the same in relation to the canceled order, including delivery costs, without undue delay and, in any case, no later than 14 days from the cancellation of the order, using the same payment method used by the user for the initial transaction.

9) Archiving orders
The order confirmation and related data will be stored in the Lab Firenze digital database for the period necessary to process the order, and in any case for the legal period. An order confirmation will be sent to the user via email with all the reference data of the order itself. These data will also be visible, for registered users, in the My ACCOUNT section

10) Conclusion of the contract
The contract is finalized when Lab Firenze receives the payment confirmation by the selected body, after checking the correctness of the data entered. 11) Product unavailability

12) Legal guarantee
Lab Firenze guarantees the conformity of the products with respect to the provisions of the relative product sheet on the site for a period of two years and in accordance with articles 128-135 of the Consumer Code to which reference is made. The warranty does not cover damage caused by mistreatment of Products, misuse, accidents, water, solvents, wear and tear, damage caused by carriers, and, in any case, damages that derive from third factors and are not attributable to defects of conformity of the products. Without prejudice to cases of willful misconduct or gross negligence, the reimbursement of damages that arise from defects of conformity of the Products and that consists of the loss of the product content and those resulting from the inability to use the product.

13) Payments
Payment for online purchases made on the Lab Firenze website can only be made and exclusively by credit card Visa – American Express – Mastercard through the International system, or through the Paypal system. The order amount will be charged to the credit card only at the time of shipment. Orders are paid externally with respect to the Firenze Lab systems (within the Setefi and Paypal servers), which therefore is in no way responsible for the processing of bank data or credit card data with which the payment itself is made.

14) Withdrawal
The buyer has the right to withdraw from the contract stipulated with Lab Firenze within 14 days working from the delivery of the products without any penalty and / or motivation. To exercise the right of withdrawal the buyer must send within 14 days from the date of receipt of the goods by registered letter with return receipt a communication expressly declaring to want to return the order. The communication can be sent also by fax and / or e-mail provided it is confirmed by registered letter with return receipt within the next 48 hours. The withdrawal may be exercised in the event of the purchase of a plurality of products, even if only for some of them. In the case of exercising the right of withdrawal, the user must return the purchased goods to Lab Firenze at their own expense, sending it to Lab Firenze within 14 days from the date of exercise of the right of withdrawal.

The dispatch must be made to the address of Lab Firenze for all the goods. In order to return the products, the products purchased must reach the address indicated above in perfect condition state of conservation. The product must be sent back with the original product packaging and with the product tag. To proceed with the return of the product, the following steps must be followed in the return procedure, accessible through the specific section.

15) Exclusion of the right of withdrawal for customized productsi

16) Returns
The packaging of the returned products (which is the responsibility of the buyer) must be made with the original box in order to prevent the goods from deteriorating at their destination. The sums paid will be credited back through the system with which payment was made. The re-credit takes place within 14 days from the last between the time when Lab Florence had news of the withdrawal and the time when Lab Florence has received the product returned by the buyer.

17) Disputes
Each sales contract concluded between Lab Firenze and the buyer pursuant to these General Conditions will be governed and interpreted in accordance with Italian laws and in particular to the Consumer Code. In any case, any rights will be reserved attributed to buyers by mandatory provisions of the law in force in the state of the latter. Lab Firenze Srl cannot be in any way considered responsible for improper use of the website and its contents by the own users.
